These Terms and Conditions govern your use of the BCA Properties website (www.bcaproperties.com), mobile applications, social media platforms and any other means of communication or contact with us (collectively referred to as “our platforms”).

BCA Properties is a registered business name owned and operated by Blackwell Consulting Allianz Investments Limited, registered in Zambia with company registration number 120160003065.

By using our platforms or engaging our services, you accept these Terms and Conditions in full. If you do not agree with any part of these terms, you must not use our platforms or services.

1. Use of Our Platforms

Age Requirement

You must be at least 18 years of age to use our platforms or engage our services. By using our platforms, you confirm that you meet this requirement.

Our platforms use cookies to improve your experience. By using our platforms, you consent to our use of cookies as described in our Privacy & Cookie Policy.

Acceptable Use

You must not use our platforms in any way that:

  • Causes damage or impairs availability or accessibility
  • Is unlawful, illegal, fraudulent or harmful
  • Transmits malicious software, viruses or harmful code
  • Involves systematic data collection (scraping, data mining, etc.) without our written consent
  • Sends unsolicited commercial communications
  • Is used for marketing purposes without our written consent

2. Our Services

BCA Properties provides real estate services across Zambia in accordance with guidelines from the Zambia Institute of Estate Agency (ZIEA) and applicable Zambian regulations.

Services We Offer

Property Sales: Assisting buyers and sellers with residential, commercial and industrial property transactions.

Property Rentals: Helping tenants find suitable properties and assisting landlords with letting their properties. We offer various listing packages; details available on request.

Property Management: Full and partial management services for residential, commercial and industrial properties, including tenant relations, rent collection, maintenance coordination and regular reporting.

Property Maintenance: Coordinating repairs, maintenance and upkeep of properties on behalf of owners.

Real Estate Advisory: Market analysis, investment guidance and advisory services for property owners, investors and businesses.

Project Management: Oversight and coordination of property development and renovation projects.

Service Agreements

Specific terms for each service are set out in separate written agreements, including:

  • Agency Mandate Agreements
  • Rental Management Agreements
  • Property Management Agreements
  • Advisory and Consulting Agreements
  • Other service-specific agreements as applicable

These agreements will detail the scope of services, fees, responsibilities and other relevant terms.

3. Fees and Commissions

Fee structures vary depending on the type of service, property type and specific circumstances. Fee details are provided upon request and confirmed in writing in service agreements before any work begins.

4. Property Listings and Information

Accuracy of Information

Property information on our platforms (including descriptions, photographs, measurements, prices and availability) is provided by property owners, sellers and landlords. While we make reasonable efforts to ensure accuracy, we do not guarantee that all information is complete, current or error-free.

We are not liable for:

  • Inaccurate property descriptions or measurements
  • Incorrect pricing information
  • Properties that become unavailable after listing
  • Misrepresentations made by property owners or sellers
  • Hidden defects or issues not disclosed to us

Users should verify all property information independently and conduct their own due diligence before making any property decisions.

Property Viewings

Property viewings are arranged at the discretion of property owners and are subject to availability. We are not liable for any injury, loss or damage that occurs during property viewings.

Listing Removal

We reserve the right to remove any property listing from our platforms at any time without notice, including listings that contain inaccurate information, violate these terms, or are no longer available.

5. Intellectual Property

Unless otherwise stated, we and/or our licensors own the intellectual property rights to all material on our platforms.

You may view, download and print property listings and other content for personal, non-commercial use only. You must not:

  • Republish material from our platforms without our written consent
  • Sell, rent or sub-license our content
  • Reproduce or exploit material for commercial purposes
  • Edit or modify our content
  • Redistribute our content for commercial gain

6. User-Generated Content

If you submit content to our platforms (including comments, feedback, property listings or reviews), you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, publish and distribute that content.

Your content must:

  • Not be illegal, unlawful or infringe third-party rights
  • Not contain false or misleading information
  • Not be defamatory, offensive or inappropriate

We reserve the right to edit or remove any user content at our discretion. We do not actively monitor all user submissions and are not responsible for content posted by users.

7. External Links and Third Parties

Our platforms may contain links to external websites or third-party services. We are not responsible for the content, privacy practices or terms of use of external sites. You access external links at your own risk.

When you engage with third-party services through our platforms (such as external property portals or service providers), you do so under their own terms and conditions. We accept no responsibility for third-party services.

8. Warranties and Disclaimers

Our platforms and services are provided “as is” without warranties of any kind, express or implied.

We do not warrant that:

  • Our platforms will be constantly available and error-free
  • Information on our platforms is complete, accurate and current
  • Our platforms are free from viruses or harmful components

Nothing on our platforms constitutes professional legal, financial, tax or medical advice. If you require such advice, consult an appropriate qualified professional.

Our property services are provided with reasonable skill and care in accordance with industry standards, but we do not guarantee specific outcomes such as achieving a particular sale price or finding a tenant within a specific timeframe.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • Indirect, special, consequential or incidental losses
  • Loss of profits, revenue, business, contracts, anticipated savings, data, goodwill or reputation
  • Any loss arising from your use of our platforms or services
  • Losses arising from inaccurate property information provided by third parties

Our total liability to you for any claim arising from our services shall not exceed the fees paid by you to us for those specific services.

Nothing in these terms excludes or limits our liability for:

  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by our negligence
  • Any liability that cannot lawfully be excluded or limited

10. Client Responsibilities

When engaging our services, you agree to:

  • Provide accurate and complete information
  • Respond promptly to communications
  • Allow reasonable access to properties for viewings, inspections and maintenance (where applicable)
  • Comply with all applicable laws and regulations
  • Pay agreed fees in accordance with service agreements
  • Notify us immediately of any material changes affecting the property or service engagement

11. Termination of Services

Either party may terminate a service agreement in accordance with the terms set out in that specific agreement.

We reserve the right to suspend or terminate your access to our platforms immediately if you breach these Terms and Conditions.

Upon termination:

  • Outstanding fees remain payable
  • Certain obligations may survive termination as specified in service agreements
  • We may retain records as required by law

12. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve it through good-faith negotiation. If negotiation fails, the dispute shall be resolved in accordance with the Laws of the Republic of Zambia through the courts of the Republic of Zambia.

13. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities and expenses (including legal fees) arising from:

  • Your breach of these Terms and Conditions
  • Your use of our platforms or services
  • Content you submit to our platforms
  • Your violation of any third-party rights

14. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated “Last updated” date.

Significant changes will be communicated via:

  • Email to registered users
  • Notice on our website
  • Social media announcements

Continued use of our platforms or services after changes are posted constitutes acceptance of the revised terms.

15. General Provisions

Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in full effect.

Assignment

We may transfer our rights and obligations under these terms to another entity. You may not transfer your rights or obligations without our written consent.

Entire Agreement

These Terms and Conditions, together with our Privacy & Cookie Policy and any service-specific agreements, constitute the entire agreement between you and us regarding your use of our platforms and services.

Waiver

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future.

16. Governing Law

These Terms and Conditions are governed by the Laws of the Republic of Zambia. Any disputes shall be subject to the exclusive jurisdiction of the Zambian courts.
